    Important Ruling By the Virginia Supreme Court     A Washington Post article, dated Saturday, September 15th, 2007, by Bridget Schulte,  reports the court has abolished the "Massachusetts Rule" wherein a neighbor suffering a loss from a falling tree, or root damage,  had no recourse to the tree's owner.  The court held that the owner of the tree is liable for damages.   The article can be found at:  
www.washingtonpost.com/wp-dyn/content/article/2007/09/14/AR2007091401340.html?referrer=emailarticle.   This decision arose from a dispute by neighbors in the adjacent Cambridge Station community where a neighboring tree's root system was destroying an adjacent home's patio.

The grantor's tax on the sale of real estate has been overturned by the Virginia Supreme Court since it was not levied by elected officials as required by the state constitution.     A particularly pernicious  part of the tax allowed the clerk of the circuit  court to levy fees based on the higher of  the sale price or the assessed  value for real estate purposes.   However, this tax idea will reappear.   Expect the tax to be be voted on by elected officials and enacted in the near future.  Politicians think every home seller is walking away with a bundle of money.  And, the idea of taxing someone who may be leaving the area is too tempting to pass by.
